Terms of use & privacy
This website presents the work of artist, illustrator and animator Amanda Pomar. Here we explain the rules for using the site and, transparently, which data we collect, why, and what your rights are, under Brazil's General Data Protection Law (Law 13,709/2018 — LGPD).
1. Terms of use
By browsing this site you agree to these terms. If you do not agree, please do not use it.
All works shown — illustrations, paintings, prints, animations, photographs, texts and the visual identity — are authored by Amanda Pomar or her collaborators and are protected by Brazilian Copyright Law (Law 9,610/1998). Copying, reproducing, distributing, modifying, using to train artificial intelligence systems or commercially exploiting any content without prior written permission is prohibited. Sharing links to the pages is welcome.
Credits for collaborators, studios and photographers are given in each project. For licensing, commissions or image use, write to pomaramanda@gmail.com.
The site contains third-party links and videos (Vimeo, YouTube, Instagram, Behance and others). We are not responsible for the content or practices of those services, which follow their own terms and policies.
We strive to keep the information accurate and the site available, but it is provided "as is", with no guarantee of uninterrupted operation.
2. Who handles your data
The data controller is Amanda Pomar. For any privacy matter, including exercising your rights, contact pomaramanda@gmail.com.
3. What data we collect
Record of your choice: when you answer this site's notice, we store the decision (accept or essentials only), date and time, the version of these terms, the language and page you were on, the browser user agent (technical identification of the browser and system), screen size and time zone. This proves your consent.
Visit metrics (only if you accept): pages visited, reading time, clicks on works and videos, wall rooms reached, clicks on contact and social links, the referring domain (e.g. "instagram.com") and the device type, browser and system.
We do not store your IP address. To count unique visitors we use a daily code, computed from the IP and browser with a secret key, which changes every day and cannot identify you or follow your visits across days.
We do not use cookies, third-party tracking tools (such as Google Analytics or social media pixels), and we do not ask for any registration data.
In your own browser (localStorage/sessionStorage) we keep only your choice in this notice and a random identifier for the open tab, which disappears when you close it.
4. Why we use it and on what legal basis
Metrics are used only to understand, in aggregate, how the site is visited — which works attract interest, whether content is read, where visitors come from — and so improve the site and the promotion of the work. The legal basis is your consent (LGPD art. 7, I), which you may withdraw at any time.
The consent record is kept to meet the obligation to demonstrate consent (LGPD art. 8, § 2).
We do not sell, rent or share this data with third parties for commercial purposes. It is stored on the site's hosting server, with access restricted to the people who manage the site.
5. How long we keep it
Visit metrics: up to 13 months, after which they are deleted automatically. Consent records: for as long as needed to prove consent, up to 5 years.
6. Third-party videos and links
Full videos (Vimeo and YouTube) only load when you click to watch. From then on, those services may collect data under their own policies — we use their enhanced-privacy versions (YouTube "nocookie" and Vimeo "dnt"). The same applies when following links to social networks.
7. Your rights
Under the LGPD (art. 18) you may, at any time: confirm whether we process your data; access it; correct it; request anonymization, blocking or deletion; request portability; know whom we share it with (no one, for commercial purposes); and withdraw consent.
Since we do not keep data that directly identifies you, when you request access or deletion we may ask for information that lets us find the record (for example, the approximate date and time of your choice). We will reply within 15 days from pomaramanda@gmail.com. You may also file a complaint with Brazil's National Data Protection Authority (ANPD).
To withdraw consent for metrics right now, use the “Review my choice” button on this page. The site also honors the browser's Global Privacy Control and Do Not Track signals.
8. Security and changes
We adopt reasonable technical measures to protect data, such as secure connections (HTTPS), restricted password-protected access to the admin and minimal collection. No system is fully immune to incidents; if one affects your data, we will notify you as required by law.
These terms may be updated. When a change affects data collection, the notice will be shown again to ask for your consent. Brazilian law applies, and the courts of Juiz de Fora (MG, Brazil) are chosen, without prejudice to consumers' right to use the courts of their own domicile.
